CHAPTER 9 - ACCESSORY BUILDINGS AND
PLAYHOUSES
9.01
GENERAL - The
following restrictions shall apply to the construction or keeping of
free standing, detached or portable accessory storage or utility
buildings in those areas of Wekiva listed at the end of this section
9.01:
(1)
Maximum height - the maximum height of the structure shall be seven
(7) feet. The structure may exceed this height by a maximum of four
(4) inches to allow for a building foundation;
(2)
Maximum size - the maximum size shall be equal to one hundred (100)
square feet;
(3)
Maintenance - all such structures must be maintained to the same
standard as is required for the maintenance of houses in Wekiva.
This includes, but is not limited to the obligation to keep such
structures painted, rust free, structurally sound and with a secure
and water tight roof.
(4)
Screening - All such structures must be screened to a height of at
least six (6) feet by a fence or other screen approved by the
Architectural Control Committee so that at least the bottom six (6)
feet of the structure and foundation, if any, cannot be seen from
any point outside of the perimeter of the lot by any person standing
at ground level outside of the perimeter of the lot. Notwithstanding
this requirement, an owner may screen such structure to height
higher than six (6) feet with natural materials, such as bushes,
shrubs, trees, etc.
(5)
Color - The color of the structure must be the same as that of the
house or the trim of the house which is located on the same lot.
The shingles, if any, must be the same style and color as are on
the house which is located on the same lot.
(6)
General - The material, location and design of all such structures
shall be subject to approval of the Architectural Control
Committee.

9.02 WEKIVA
HILLS SECTIONS ONE AND TWO - Due to the specific total screening
requirements contained in the Supplemental Declarations which apply
to those sections, (Article VIII, Section 3) the following
restrictions shall apply to the construction or keeping of free
standing, detached or portable accessory storage or utility
buildings in WEKIVA HILLS SECTIONS ONE AND TWO:
(1)
Maximum height - the maximum height of the structure shall be seven
(7) feet. The structure may exceed this height by a maximum of four
(4) inches to allow for a building foundation;
(2)
Maximum size - the maximum size shall be equal to one hundred (100)
square feet;
(3)
Maintenance - all such structures must be maintained to the same
standard as is required for the maintenance of houses in Wekiva.
This includes, but is not limited to the obligation to keep such
structures painted, rust free, structurally sound and with a secure
and water tight roof.
(4)
Screening - All such structures must be screened to the full height
of the structure by a screen approved by the Architectural Control
Committee so that the structure is screened from view from the
street and/or adjacent properties.
(5)
Color - The color of the structure must be the same as that of the
house or the trim of the house which is located on the same lot.
The shingles, if any, must be the same style and color as are on the
house which is located on the same lot.
(6)
General - The material, location and design of all such structures
shall be subject to approval of the Architectural Control Committee.
9.03 AREAS
WHERE PROHIBITED - Accessory, storage or utility buildings are
strictly prohibited in the following areas of Wekiva:
(1)
Wekiva Hills Sections 3 through 10;
(2)
Wekiva Club Sections 1 through 9;
(3)
Wekiva Fairway Townhomes;
(4)
Wekiva Orange County Sections 1 through 5.
9.04
PLAYHOUSES - The construction of "playhouses" or other
structures of similar type and purpose shall be subject to the
restrictions set forth in Section 9.01 supra. "Playhouses" are,
however, strictly prohibited in the following areas of Wekiva:
(1)
Wekiva Hills Sections 1 through 10;
(2) Wekiva
Club Sections 1 through 9;

Orange County Sections 1 through 15.

9.05
GAZEBOS – The following restrictions shall apply to the
construction or keeping of a free standing gazebo in those areas of
Wekiva, as listed in the permitted areas in this section 9:05:
Prohibited Areas – Gazebos
are strictly prohibited in the following areas of
Wekiva:
a. Wekiva Hills Sections 3 through 10;
b. Wekiva Club Estates Sections 1 through 10;
c. Wekiva Fairway Townhomes;
d. Wekiva Orange County Sections 1 through 5
Permitted Areas:
a.
Fox Hunt Sections 1, 2, and 3;
b.
Wekiva Golf Villas Sections 1, 2, and 3;
c.
Governors Point Phases 1, 2 and 3;
d.
Hunters Point;
e.
Hunters Glen;
f.
Villas on the Green Condominiums I and II
g.
Hunt Club Condominiums;
h.
Wekiva Hills Section 1 and 2
In those areas
where gazebos are permitted the following guidelines apply:
(1)
Gazebos must be detached
from the main residential structure and must have a minimum obstructive ten (10) foot clearance from any fence,
structure, pool, etc.
(2)
Applicant to submit to Association the ACC form, survey, site
plan showing the location of the structure, landscaping plans, and
building plans.
(3)
As part of the approval process, the structure must be approved
by the county, to include permits and set backs, as required by the
county.
(4)
Design Requirements:
a.
Structure Height – The maximum height of the structure shall be
ten (10) feet as measured from the sites average grade to the crown of
the roof.
b.
Maximum Size – The maximum size shall be equal to 100 square feet
as measured around the exterior perimeter of the primary structure.
c.
Structure Materials – All gazebos must be constructed of finished
material, and painted or stained and varnished.
d.
Roofing – All roof cladding must be either cedar shakes, copper,
finished standing seam metal, slate, or asphalt shingles that shall be
the same color as the roof of the home.
e.
Opening Treatments – Generally gazebos are open structures with a
railing around its base. Variations from this that will be permitted
include: screening, sliding lattice panels for privacy when needed or
fixed lattice for one to two (2) sides.
f.
Buffering – All gazebos shall include a landscape plan
illustrating the proposed landscaping around its perimeter. Special
attention must be given to views from the street and/or adjacent
properties. The landscaping for this area must consist of plant
material that will provide a dense sight line screening.
g.
Electric – Gazebo may be wired for
electricity.
The construction plans, materials, roofing
materials, color, style, landscaping and massing must be approved by the
Architectural Control Committee, as provided elsewhere in the Wekiva
Code.
(6)
Maintenance – All gazebos must be maintained to the same
standard as required for the maintenance of houses in Wekiva. This
includes, but is not limited to the obligation to keep such structure
painted, structurally sound and with a secure and water tight roof.
(7) Use of Gazebo – No Gazebo may be used
for any other purpose than
gathering/sitting/resting place for
homeowners and their guests. And nothing may be stored inside the
structure other than items specifically designed for gazebos, i.e., lawn
or patio furniture.
(8)
Any modification to the above will require a variance, except in
areas where specifically prohibited. (For variance procedure see
Chapter 16)

9.06 PLAY SYSTEMS - The following
restrictions shall apply to the construction or keeping of Play Systems
in Wekiva: The following guidelines apply:
General:
The material, location and design of all play systems shall be subject
to the approval of the Architectural Control Committee.
1.
Applicant to submit to Association the ACC form, site plan
showing location of the structure, materials, color and style.
2.
Play systems must be detached from the main residential structure
and must have a minimum obstructive ten (10) foot clearance from any
fence, structure, pool, etc.
3.
All structures must be screened to a height of at least six (6)
feet by a fence or other screen approved by the Architectural Control
Committee. Notwithstanding this requirement, an owner may screen the
play system to a height higher than six (6) feet with natural material,
such as bushes, shrubs, trees, etc.
(5) Design
Requirements:
a.
Structure Height- The maximum height of the play system
shall be ten (10) feet as measured from the sites average grade to the
top of the play system.
b.
Structure Materials – All play systems must be constructed
of a finished material, painted, stained or varnished
(6) Maintenance:
All play systems must be maintained to the same standard as
required for the maintenance of houses in Wekiva. This includes, but is
not limited to the obligation to keep the play system structurally
sound, painted and rust free.
(7) Variance:
Any modification to the above will require a variance and variance
must be approved by the Board of Directors at a duly called Board
meeting and resident requesting the variance must be present at
this meeting. (For variance procedures see Chapter 16)

9.07 DECORATIVE YARD
ACCESSORIES – The following restrictions shall apply to the
installation or keeping of non-seasonal, decorative yard accessories in
Wekiva: The following guidelines apply:
General: The material, location and design of all
decorative yard accessories, i.e. decorative water fountains and
statues, shall be subject to the approval of the Architectural Control
Committee.
(1) Applicant to submit to Association the
ACC form, site plan showing the location of the structure, structure
materials, color, height and style.
Maintenance: All yard decorations must be maintained to
the same standard as required for the maintenance of houses in Wekiva.
